Question about Count-in & Songs with long intros

Hey.
So, I’m curious about something involving count-in and sounds with longer intros where there are no charted notes.
As an example, use Rush – Carnies:
As you can see, the first 22 seconds is nothing that is being charted out. The guitar starts in at 23.
Right now, I moved the count-in from the beginning of the song (2 measures before it starts) to the 2 measures before the guitar starts in. It’s blended into the intro section, so that you get the count-in right before players actually play. I felt it sort of stupid to have a count-in 20+ seconds before you start, as what is there point there of keeping rhythm.
First question: Is that alright to do? Have the count-in 20+ seconds in where the playable song starts?
Next, how does the “no notes before 3 seconds work” or whatever. If I have no notes/events that are being played, can I get rid of the 2 measures of [now] silence that precede the song? Can the song simply start at 0:00:00, since I’m fine with that intro part playing over the building HUD.
Is that alright to do as well? There a several songs on this album that have a similar situation, so I’m checking first before I change anything. I would like to not have 2 measures of silence if there is not a need.

I honestly assumed both would be fine, but just wanted to make sure before changing a lot. I can also vaguely remember the Harmonix charts doing that so I wasn’t sure if that was just me ha.
